Terms & Conditions
1. Definitions

“Company”, “we”, “our”, “us” refers to Alex Cullum Limited, trading as South East Scaffolding.

“Customer”, “you”, “your” refers to any individual, business, or entity using our services.
-
“Services” refers to the introduction, arrangement, or facilitation of scaffolding works through third-party scaffolding contractors (“Contractors”).
-
“Agreement” refers to these Terms & Conditions, together with any order, quotation, or confirmation agreed in writing.
-
“Contractor” refers to any third-party scaffolding company we introduce to the Customer.

2. Nature of Services

We operate as a broker, arranging scaffolding services on behalf of Customers with third-party Contractors.
-
We do not own scaffolding equipment, nor do we directly erect, dismantle, or hire out scaffolding.

Our role is limited to:
-
Introducing Customers to suitable Contractors.
-
Facilitating quotations, negotiations, and communications.
-
Assisting with project coordination where agreed.

3. Quotations & Pricing
-
Any quotation provided through us is based on information supplied by the Customer and the Contractor.
-
All prices are determined by the Contractor. We do not guarantee pricing accuracy or final costs.

Quotations are valid for 30 days unless otherwise stated by the Contractor.
-
Any changes to the scope of work may result in revised pricing.

4. Contracts with Contractors
-
The final contract for scaffolding services is between the Customer and the Contractor.
-
We are not a party to that contract and accept no liability for performance, workmanship, or safety standards.
-
The Contractor is solely responsible for:
-
Licensing and regulatory compliance.
-
Health and safety standards.
-
Insurance cover (public liability, employer’s liability, etc.).
-
Completion of works in line with their quotation.

5. Payment

Depending on arrangements, payment may be:
-
Made directly to the Contractor, or
-
Processed through us as a broker (in which case we will hold and forward payment as agreed).

Where payments are made to us, standard terms are 30 days from invoice date, unless otherwise agreed.

We reserve the right to charge interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Customer Obligations
The Customer must:

Provide accurate project details to enable us and Contractors to prepare realistic quotations.

Ensure necessary permissions and licenses are obtained (e.g., highway permits).

Maintain safe site access for Contractors.
-
Communicate promptly to avoid delays.

7. Company Obligations
We will:
-
Use reasonable skill and care when recommending Contractors.
-
Pass on customer requirements clearly and accurately.
-
Facilitate communication between Customers and Contractors where required.
-
Maintain appropriate records of introductions and communications.

We do not guarantee:
-
The availability of any Contractor.
-
The quality, safety, or timeliness of Contractor work.

8. WhatsApp & Electronic Communications
-
We may use WhatsApp Business and other messaging platforms to communicate.
-
You will only receive WhatsApp messages if you have provided your number and opted in.
-
Opted-in communications may include:
-
Updates on quotes
-
Coordination messages
-
Invoices or payment reminders
-
Relevant offers or updates
-

You can withdraw consent at any time by replying STOP on WhatsApp or contacting us at David.King@southeastscaffolding.uk.

We will not share your WhatsApp messages with other customers.

9. Liability

As a broker, we accept no liability for:
-
Workmanship, safety, or regulatory compliance of Contractors.
-
Delays, damages, or losses arising from Contractor performance.
-
Any injury, loss, or damage caused by the erection, dismantling, or use of scaffolding.

Our liability is strictly limited to:
-
Losses directly arising from our own negligence in the brokering process.
-
In such cases, our liability shall not exceed the brokerage fee paid to us for the relevant project.

Nothing in this Agreement excludes liability for death or personal injury caused by our negligence, fraud, or liability that cannot legally be excluded.

10. Termination

We may withdraw or suspend Services at any time if:
-
The Customer fails to provide accurate information.
-
The Customer fails to make agreed payments.
-
Communication becomes unreasonable or abusive.
-

The Customer may terminate our involvement at any stage, subject to payment for any fees or costs incurred up to the termination date.

11. Force Majeure
We are not liable for delays or failures due to events beyond our control, including severe weather, strikes, or third-party failures.

12. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
